This page provides information about the formation of the library district which was created from the Adams County Library System. A contest to give a new name to the Library District began March 18th, 2004 and ran through April 17th, 2004. The Library Board choose a name from among the top three finalists at the Board Meeting on April 21st, 2004. A contest was held to create a new logo for the district. The contest ran between May 20th, 2004 and June 18th, 2004. The new logo was selected by the Board at the June 23rd, 2004, meeting. On February 11th, 2004, the Board of Adams County Commissioners appointed five people to be on the Board of Trustees for the Adams County Library District. They are:

At a regular meeting of the Board of County Commissioners for Adams
County, Colorado, held at the Administration Building in Brighton, Colorado on

following proceedings, among others were held and done, to-wit: RESOLUTION ESTABLISHING A LIBRARY DISTRICT AND
MERGING THE ADAMS COUNTY LIBRARY SYSTEM INTO THE LIBRARY DISTRICT PURSUANT TO
THE COLORADO LIBRARY LAW WHEREAS, public libraries have historically been an
integral part of the informational, educational, and cultural milieus of
communities in Adams County; and, WHEREAS, pursuant to the Colorado Library Law, §
24-90-101, et seq., C.R.S., as amended, the BOCC historically has been
and continues to be committed to making available in Adams County
publicly-supported, free library services providing information accessible to
users regardless of age, physical or mental health, or economic status; and, WHEREAS, pursuant to the Library Law, the Adams
County Library System (ACLS) was formed by resolution of the Board of County
Commissioners (BOCC) in 1988; and, WHEREAS, based on an assessment performed by a
professional consulting firm, it has been determined that the residents of Adams
County desire enhanced facilities and services to meet the technological and
informational needs of the public; and, WHEREAS, based on the recommendations of the ACLS
Board of Trustees (BOT) and the director of the Adams County Department of Human
Development (ACDHD), the BOCC has determined that formation of a library
district is necessary to ensure the viability, sustainability, and sound fiscal
future of publicly-supported, free library services in Adams County; and, WHEREAS, pursuant to the Library Law, the formation
of a library district will offer greater opportunities for flexibility in
financing and independence of focus than have been available to the ACLS; and, WHEREAS, pursuant to §§ 24-90-106 and 107(1), C.R.S.,
as amended, the BOCC is expressly authorized to establish a library district
upon providing adequate notice and a public hearing; and, WHEREAS, pursuant to §§ 24-90-103(12) and
107(2)(b), C.R.S., as amended, notice has been given of the public hearing held
this date concerning establishing a library district, as evidenced by the
affidavits of publication that are attached hereto and incorporated herein by
this reference collectively as Exhibit “A.”
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, County of Adams, State of Colorado, that a library
district, as defined and provided for under the Library Law, shall be
established as of January 1, 2004 and shall be known as the “Adams County
Library District (ACLD).” BE IT FURTHER RESOLVED that, pursuant to §
24-90-103(6), C.R.S., as amended, the ACLD shall be established and maintained
by Adams County acting alone and not formally in concert with any other
government units. BE IT FURTHER RESOLVED that, concomitant with the
establishment of the ACLD, the ACLS shall be fully merged into and become a part
of the district, as more specifically enumerated herein, so that the ACLS shall
no longer exist as a separate or distinct entity. BE IT FURTHER RESOLVED that the ACLD shall be a
“public library,” as defined under § 24-90-103(13)(a), C.R.S., as amended,
and shall be operated and maintained for the free use of the public residing
within its legal service area, shall be operated and maintained in whole or in
part with money derived from local taxation, and shall be open to the public a
minimum number of hours per week in accordance with rules established by the
state library. BE IT FURTHER RESOLVED that, pursuant to §
24-90-103(5), C.R.S., as amended, the ACLD shall be a political subdivision of
the state. BE IT FURTHER RESOLVED that, upon the establishment
of the ACLD, the legal service area of the ACLS, which includes all of the
territory of Adams County, except for those portions included within the
incorporated limits of the cities of Westminster and Aurora and the Deer Trail
School District 26-J, as more particularly described in Exhibit “B” that is
attached hereto and incorporated herein by this reference, shall become that of
the ACLD, as such legal service area is defined under § 24-90-103(4.5), C.R.S.,
as amended. BE
IT FURTHER RESOLVED that, upon the establishment of the ACLD, the 1.386 mill
levy tax imposed on real and personal property in the legal service area of the
ACLS for the establishment, operation, and maintenance of public library
services, pursuant to § 24-90-112, C.R.S., as amended, which amount of mill
levy tax and all other revenues of the ACLS have been exempted by voter approval
from the revenue and spending limits of the Taxpayer’s Bill of Rights (TABOR),
Colo. Const. art. X, § 20, since January 1, 2000, shall become the mill levy
tax of, and continue to be imposed on behalf of, the ACLD. BE IT FURTHER RESOLVED that, pursuant to TABOR, Colo.
Const. art. X, § 20 and § 24-90-107, C.R.S., as amended, upon the
establishment of the ACLD there shall be no increase in the 1.386 mill levy tax
without prior approval of a majority of the electors of the ACLD legal service
area. BE IT FURTHER RESOLVED that it is anticipated that
the imposition of such mill levy tax shall result in property tax revenues to
the ACLD in the amount of $3,474,561 during calendar year 2004, and that
additional revenues in the form of state or federal grants or private gifts and
donations are anticipated to be in the amount of $488,390 during calendar year
2004, for a total anticipated revenue of $3,962,951. BE IT FURTHER RESOLVED that the transfer to the ACLD
of any other assets and liabilities held or incurred by Adams County on behalf
of the ACLS, including its employees and any real and personal property, shall
be in accordance with the terms of an intergovernmental agreement (IGA) that
shall fully set forth the rights, obligations, and responsibilities of all
parties, pursuant to § 24-90-107(2)(e), C.R.S., as amended, and shall be
entered into within ninety (90) days after the appointment of the ACLD Board of
Trustees. BE IT FURTHER RESOLVED that, upon the establishment
of the ACLD, the Public Library Fund established for the ACLS, pursuant to §
24-90-112, C.R.S., as amended, shall become the Public Library Fund of the ACLD,
and all moneys held therein shall be transferred to the ACLD in accordance with
the IGA. BE IT FURTHER RESOLVED that, pursuant to §
24-90-108(1), C.R.S., as amended, the management and control of the ACLD shall
be vested in a board of trustees that shall be comprised of five (5) members,
all of whom shall reside with the ACLD legal service area. BE IT FURTHER RESOLVED that, until the appointment of
the ACLD BOT, which is anticipated to occur on or before February 9, 2004, the
ACLS BOT shall continue to hold office and perform its duties and
responsibilities in accordance with the ACLS Bylaws. BE IT FURTHER RESOLVED that the ACLD BOT shall be
appointed to terms of office, and may be removed from office, by the BOCC in
accordance with § 24-90-108, C.R.S., as amended, as shall be more specifically
enumerated in the IGA. BE IT FURTHER RESOLVED that recommendations for
appointments to the ACLD BOT may be made to the BOCC by any resident or
government unit within the legal service area of the ACLD, and solicitations for
such recommendations shall be publicized upon the direction of the BOCC. BE IT FINALLY RESOLVED that it is anticipated that
the ACLD will operate with the oversight and supportive services of Adams County
through calendar year 2004, as shall be more specifically enumerated in the IGA,
and will not become independently operational until at least January 1, 2005. Upon motion duly made and seconded the foregoing resolution was adopted
